This was a long but good weekend. I went through the NHTSA (National Highway Safety Traffic Administration) training this weekend. NHTSA is the agency who runs and controls the training for law enforcement agencies in regard to DWI/DUI detection. This agency certifies police officers to administer the three field sobriety tests (horizontal gaze nystagmus, walk and turn test and one leg stand test).
After three days of intense training, I have now been certified as a practitioner in the field sobriety tests by NHTSA. This means that I have the same training and certification as police officers who make arrests for DWI/DUI in the state of Texas. This course really opened my eyes to the inherently flawed procedures and assumptions that officers use to charge people with DWI in Texas. It was an invaluable training experience and I can not wait to cross-examine the next police officer I come across in a DWI trial.
Thank you to Lance Platt of Walden, Platt and Associates for the training session. This gentleman is a former police officer and has trained hundreds of police officers in the policies an procedures implemented by NHTSA. Mr. Platt left law enforcement and is now a fierce and fair advocate against the flaws and assumptions used by NHTSA to arrest and prosecute citizens of DWI. Our office frequently uses Mr. Platt to evaluate our clients’ DWI cases for deviations of protocol and NHTSA policies.
Thank you Mr. Platt and beware to all law enforcement. There is nothing scarier to a police officer than an attorney with equal training and superior knowledge that will cross-examine him in a trial. I can’t wait for my next trial.
