DWI trials are very complicated and there are a lot of things that can derail even the best defenses. Last week, I was counsel in a very tough case against two extremely talented prosecutors in a local county. I believe I fought hard for my client, but unfortunately the jury returned a verdict of guilty.
I have reported here before about some of my DWI trial wins. So, it is only fair that I give prosecutors their due respect when they do a good job and obtain a conviction of one of my clients. Like I have said in this blog before, I will never give prosecutors names or the counties in which they work, but the two gentlemen who prosecuted the case that I lost know who they are and were both congratulated by me personally.
To date, I have tried almost 20 cases to verdict this year. That is far more than most defense attorneys will try in two or even three years. When you try that number of cases, there are going to be some that will be tough to win. Remember what I have said before, there are no Denny Crane’s (Boston Legal, he never lost a case) in the real world. Any attorney who tells you he or she has never lost a case: 1) is not being truthful; 2) has only tired a handful of cases or 3) SEE #1. However, although my client was convicted, he was ultimately sentenced to an extremely light punishment for a DWI. His punishment was far better than the plea offer originally extended by the prosecution. So, although we came up short in our defense, my client took his chance at trial and ultimately came out ahead. Like the saying goes, “Sometimes you win, sometimes you lose and sometimes it rains.” Congratulations gentleman! You earned it and I look forward to the next trial.
