This was a long but good weekend. I went through the NHTSA (National Highway Safety Traffic Administration) training this weekend. NHTSA is the agency who runs and controls the training for law enforcement agencies in regard to DWI/DUI detection. This agency certifies police officers to administer the three field sobriety tests (horizontal gaze nystagmus, walk and turn test and one leg stand test).

Law enforcement officers in all 50 states utilize Standardized filed sobriety tests (SFSTs) to determine the impairment of a person’s driving due to alcohol influence. The SFSTs are comprised of a battery of three tests: 1) Horizontal Gaze Nystagmus test (HGN), 2) Walk and Turn Test (WAT) and 3) One Leg Stand Test (OLS). Out for Blood: Another Texas Police Department to Begin Obtaining Blood Warrants for DWI Suspescts.

Following the lead of the Fort Worth and Arlington police departments who routinely declare “no refusal” weekends in which the police seek warrants for blood from DWI suspects, the Burleson police department has declared warrant war on DWI suspects.

A common question that I receive from potential DWI clients is, “what do police officers look for before making an arrest for DWI?” The best way to answer this question is to give a little explanation on who trains officers and how officers are trained. The National Highway Transportation Safety Administration (NHTSA) is in charge of training officers throughout Texas and all 50 states. Before an officer can become “certified” to perform a DWI investigation, he or she must complete a comprehensive course taught by NHTSA instructors and pass certain proficiency exams. If an officer completes the course and exams, he or she is then “certified” to perform a DWI investigation.
